Welcome to the MH Community Data Services (“MHCDS”) website. By accessing or using this website (the “Site”), you agree to be bound by these Website Terms of Use (the “Terms”). If you do not agree, you must discontinue use of the Site.

1. Acceptance of Terms

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MHCDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE

• MHCDS’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100)

These limitations apply regardless of legal theory and even if MHCDS has been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless MHCDS and its officers, employees, and agents from any claims, damages, liabilities, or expenses arising out of:

• Your violation of these Terms

• Your violation of any third‑party rights

13. Termination

MHCDS may suspend or terminate your access to the Site at any time, with or without notice. Upon termination, you must cease all use of the Site.

Sections 7–14 survive termination.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Ohio, without regard to conflict‑of‑law principles.

Any legal action relating to these Terms shall be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction.

15. Changes to These Terms

MHCDS may modify these Terms at any time. Updates will be posted on the Site. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
